* Reissue of the 1667 Blaeu edition, which is based on the final
edition produced by the author. With De Mari Libero and the Annotata
in Epistolam Pauliad Philemonem, a commentary on St. Paul's Epistle to
Philemon. First published in Paris in 1625, it established the system
of modern public international law, based on the concept of "droit
naturel," a morality-based law that superseded the laws of individuals
or nations. Though based on Christian natural law, Grotius advanced
the novel argument that his system would still be valid if it lacked a
divine basis. In this regard Grotius pointed to the future by moving
international law in a secular direction. OCLC locates two copies. Ter
Meulen and Diermanse, Bibliographie de Grotius 580.

5. Nice Copy of Important Kelsen Treatise
Kelsen, Hans [1881-1973]. General Theory of Law and State. Translated
by Anders Wedberg. Cambridge: Harvard University Press, 1946. xxxiii,
516 pp. Cloth very good in lightly worn dust jacket with some fading
to spine. A nice copy. $250.
* Second printing of first edition (1945). "This book is more than a
thorough and authoritative presentation by Dr. Kelsen of his pure
theory of law. The pure theory of law covers 388 pages, and this, of
course, includes the theory of the state as well as the theory of the
law. In addition, there is an appendix in which various philosophical
approaches...are presented. And following the appendix is a valuable
list of writings by Kelsen--his books, articles, and translations of
both--and then a list of writings by other scholars in which the pure
theory of law is discussed.... No one can approach this magnificent
philosophical structure without respect and lasting admiration for an
intellectual system equal in completeness to the work of Aristotle and
the medieval system-builders. And yet, the grander it is and the more
complete it is, the more restive may be its effect on those who study
it.": Paul Sayre, Harvard Law Review 59:1184-1188 cited in Marke, A
Catalogue of the Law Collection at New York University (1953) 914.

6. "The Ornament of the Common Law"
Littleton, Sir Thomas [1402-1481]. Littleton's Tenures in English. A
New Edition, Corrected. London: J. & W.T. Clarke, 1825. xvi, [iv],
341, [3] pp. Includes three-page publisher catalogue. 12mo. (3-1/2" x
5-1/2"). Original printed paper boards, untrimmed edges. Some soiling
and moderate rubbing with wear to spine, board edges and corners,
front hinge starting, partial split between final text leaf and rear
free endpaper. Title page printed in red and black. Owner signature in
pencil to front free endpaper, interior otherwise clean. Appealing.
$450.
* Written during the reign of Edward IV [1442-1483] and first
published around 1481, Littleton's Tenures is probably the most
revered treatise in the history of the common law. Much admired for
its learning and style, it is concerned with tenures and other issues
relating to real property. This venerable work, which Coke called "the
ornament of the Common Law, and the most perfect and absolute work
that ever was written in any humane science," is a considered a
landmark because it renounced the principles of Roman law (and Latin)
in favor of a set of guidelines and doctrines drawn from the Year
Books, and when necessary, hypothetical cases. Holdsworth, A History
of English Law II:573. Sweet & Maxwell, A Legal Bibliography of the
English Commonwealth of Nations I:455 (111).

7. 1881 Study on the Social History and Law of Drinking

History of Intoxicating Liquors. Albany: Weed, Parsons and Company,
1881. iv, 241 pp. Original cloth, blind frames to boards, large gilt
title to front. Light rubbing with wear to corners and spine ends,
some fading to backstrip, hinges cracked but secure. Early signature
in pencil to front free endpaper, brief early annotation in pencil to
head of preface, interior otherwise clean. $250.
* In a manner similar to twentieth century sociological jurisprudence,
this book presents an interesting history of drinking that blends
sociology, law and legislation. The latter chapters examine the
current laws of the United States and Canada in theory and practice.
Rogers, a Canadian barrister, was the author of the popular series
Legal Recreations, a series of books on transportation law, hotel law,
medical jurisprudence and other subjects. OCLC locates 20 copies. Not
in the Harvard Law Catalogue (1909) or the British Museum Catalogue.

8. Collection of Trials From the Library of William Roughead
[Scott, Sir Walter (1771-1832), Editor (Attributed)]. Criminal Trials,
Illustrative of the Tale Entitled "The Heart of Mid-Lothian,"
Published From the Original Record: With a Prefatory Notice, Including
Some Particulars of the Life of Captain James Porteous. Edinburgh:
Printed for Archibald Constable and Company, 1818. xxxvi, 344 pp.
Lithographed frontispiece of the tollbooth at Edinburgh. 12mo. (4-1/4"
x 6-3/4"). Contemporary crushed morocco, gilt frames to boards,
lettering piece and gilt ornaments to spine, top edge gilt, marbled
endpapers, inside dentelles. Light rubbing to boards, some wear to
joints, corners and spine ends, a few negligible vertical creases to
spine. Armorial bookplate of William Roughead to front pastedown,
early annotation to verso of front free endpaper, embossed owner stamp
to following endleaf, small early signature to head of title page.
Faint offsetting to title page, interior otherwise fresh. $350.
* First published in 1818, Scott's The Heart of Mid-Lothian is one of
his best novels. Set between the two Jacobean insurrections and during
the 1736 Porteous Riots, it is considered a national epic by many
Scots. Containing accounts of the trials that followed the riots,
Criminal Trials was published as a companion to Scott's novel.
Attributed originally to Charles Kirkpatrick Sharpe, it now appears to
have been compiled by Scott. A Scottish lawyer and criminologist,
William Roughead [1870-1952] attended every significant murder trial
held in Edinburgh's High Court of Justiciary between 1889 and 1949 and
published accounts of them in a series of best-selling books. He was
an editor of the Notable British Trials Series, and its most
distinguished author. Todd & Bowden, Sir Walter Scott: A
Bibliographical History 123A

9. Recommended for International Law Libraries
Walker, Thomas Alfred. A History of the Law of Nations. Vol. I. From
the Earliest Times to the Peace of Westphalia. Cambridge: At the
University Press, 1899. xxx, 361 pp. Complete as issued. Octavo (6" x
9"). Original cloth, minor shelfwear, binding slightly cocked. Some
discoloration to endleaves, interior otherwise clean. A nice copy.
$250.
* Only volume published. This study is distinguished by its lucid
discussion of the theoretical principles of international law and its
detailed analyses of works by Victoria, Ayula, Gentili and Grotius.
"This work is referred to by Fenwick as sufficiently important to
warrant being listed as part of a working library of international
law.": Fenwick, International Law, third edition xxv-l cited in Marke,
A Catalogue of the Law Collection at New York University (1953) 584.

10. Deeply Influential International Law Treatise
Zouche, Richard [1590-1661]. Juris et Judicii Fecialis, Sive Juris
Intergentes, et Quaestionum de Eodem Explicatio, Qua Quead Pacem &
Bellum Interdiversos Principes aut Populos Spectant, Expraecipuus
Historico-Jure-Peritis, Exhibentur. The Hague: Johannis Verhoeve,
1659. xxiv, 384 pp. 12mo. (3" x 5"). Handsome period-style speckled
calf, raised bands, gilt title to spine, speckled edges, endpapers
renewed. Woodcut printer's device to title page, head and tail-pieces.
Light soiling and wear to edges to title page and following two
leaves, negligible dampstaining to fore-edges of a few leaves,
interior otherwise fresh. A very attractive copy. $1,750.
* Reprint of second edition (Oxford, 1658). Zouche was an advocate of
Doctors' Commons, Judge of the High Court of Admiralty and Regius
Professor of Civil Law at Oxford. He published treatises on several
legal topics, but his lasting fame rests on the present work, which
was first published in 1650. Drawing on the work of Gentili and
Grotius, it was the first work to treat the law of nations as an
ordered system, one in which the law of warfare played a subordinate
role. It also helped to popularize the work of Grotius and Gentili and
to make international law a part of English law. According to
Holdsworth, this book succeeded for three reasons: "In the first
place, (...) international law appeared for the first time in a
compact and orderly form. In the second place, he so clearly defined
it that no one in the future could be under any misapprehension as to
its scope. In the third place, he originated the modern division of
the subject into Peace and War." He notes, moreover, that "in his book
the tradition, inherited from the medieval books, of grouping the
whole subject round the rules of war, was finally abandoned." The
influence of this study beyond the seventeenth century is evident in
its inclusion in the series Classics of International Law by the
Carnegie Foundation (Washington, 1911). Holdsworth, Sources and
Literature of English Law 227. Sweet & Maxwell, A Legal Bibliography
of the British Commonwealth of Nations I:603.
