12, xi pp. Octavo (5-1/2" x 8-3/4"). Contemporary sheep, lettering
piece, blind fillets to boards and spine. Moderate rubbing, a few
scuffs to boards, some wear to corners, front joint and foot of spine,
some chipping to head. "1833" in later hand to center of spine, early
owner signature to front pastedown. Offsetting and light foxing to
endleaves, interior otherwise notably fresh. An appealing copy of an
important work. $850.
* Second edition. The first edition of this classic treatise was
published in 1824. Its final edition, the seventh, appeared in 1877.
"The law in relation to water courses is becoming daily of increased
importance, and Mr. Angell, in his work, has commendably discussed the
subject. Local legislation has altered, in many of the states, the
common law relative to water courses, but this does not preclude the
necessity in many cases of resorting to well settled principles in
order to expound these legislative acts. No intelligent lawyer can
well practice without Mr. Angell's treatise on water courses.": Kent,

2.   Significant Treatise on Employer's Liability and Personal Injury
Bailey, W[illiam] F[rancis]. The Law of the Master's Liability for
Injuries to Servant. St. Paul: West Publishing Company, 1894. ix, 647
pp. Octavo (6" x 9"). Contemporary law calf, red and black lettering
pieces and raised bands to spine, blind double frames to boards. Some
rubbing to backstrip, board edges and corners. Light offsetting to
margins of endleaves, interior otherwise clean and bright. A well-
preserved copy. $250.
* First edition. This treatise was published at a time when personal
injury law had swollen to vast proportions in response to the growth
of industry after the Civil War. Bailey's treatise aimed to make sense
of this unruly tangle of statute and judicial decision. "No branch of
the law," he stated in the preface was "more fraught with
perplexities" (v). Indeed, it was so complicated that he expressed
hope that the current system would be replaced by "a uniform code of
laws" (vi). Friedman discusses this book in his chapter on torts in A
History of American Law 424-425. Catalogue of the Library of the

3.        Entertaining Memoirs of Serjeant Ballantine
Ballantine, Mr. Serjeant [William] [1812-1887]. Some Experiences of a
Barrister's Life. New York: Henry Holt and Company, 1882. xxi, 527 pp.
Portrait frontispiece with tissue overlay. Contemporary three-quarter
morocco over marbled boards, raised bands, gilt title and ornaments to
spine, marbled endpapers, top edge gilt. Negligible rubbing to boards,
minor wear to spine ends, joints and corners, small chip to head of
spine. Early annotation to verso of front free endpaper, internally
clean. A handsome copy. $150.
* One-volume reissue of the first London edition, 1882. Ballantine was
a successful serjeant-at-law specializing in criminal cases who was
esteemed for his ability in cross-examination. His defense of the
Tichborne claimant was perhaps his finest hour. The balance of his
entertaining memoir offers a vivid account of legal London during the
age of Dickens, Trollope and Queen Victoria.

4.         Denunciation of the French Revolution's Ideals

Politiques. Paris: Chez Le Clere, 1802. 3 volumes. Octavo (4-3/4" x 8-
3/4"). Contemporary tree calf, gilt spines with lettering pieces,
gauffered board edges, ribbon markers. Minor wear to spine ends, board
edges and corners, front and rear hinges of Volume 2 just starting.
Faint foxing to a few leaves, tiny spark burn to another, interiors
otherwise fresh. A very handsome copy of an uncommon work. $750.
* First edition. This work contains the most detailed exposition of
the principal ideas of the important highly conservative political
philosopher and statesman. Like the influential Catholic thinker
Joseph de Maistre, Bonald believed the French  Revolution was the
result of egotistical tendencies in society that were introduced by
the Protestant Reformation and popularized by the Philosophes. Wishing
to restore the organic unity of pre-revolutionary French society, he
called for the restoration of monarchical and ecclesiastical authority
as it existed during the seventeenth century. His philosophy had a
considerable influence on the modern neo-Catholic traditionalist

Forms of Precedents Relating Thereto, and Adapted to the Present
Situation of the United States. Dover (New-hampshire): Printed for
Eliphalet Ladd, 1792. viii, 484 (i.e. 454), [1] pp. Octavo (4-3/4" x
7"). Contemporary sheep, raised bands. Moderate rubbing with some wear
to joints, small scuff to spine, a series of small punctures to front
board, a few scratches to rear, rear joint starting. Early owner names
and annotations to title page and endleaves. Clean tears to two leaves
mended with archival tape, lower corners lacking from two leaves, one
with minor loss to text. Occasional light foxing, interior otherwise
clean. In all a solid copy. $550.
* Second edition. First edition issued after the American Revolution.
An exact reprint of the first Ladd edition, with the exception of a
second preface dated August 30th, 1792. It covers civil as well as
criminal topics such as arrest, bastards, bribery, conspiracy, escape,
execution, extortion, felony, homicide, indictment, libel,
"lunaticks," nuisance, oaths, rape, search warrants, slander, treason,
wife and woman. Contains forty-five pages of forms following the text.

leaves, faint dampstaining to preliminaries, toning to portions of
text, interior otherwise bright. An appealing copy of an uncommon

Caldwell intended this work to replace Kyd's A Treatise of the Law of
Awards (1791), which Caldwell felt was out of date. It contains a
thorough overview of the subject and provides a large number of

* First edition. With forms. Written by a New York lawyer, this manual
of civil and criminal law follows the general arrangement of Burn's
English Justice of the Peace. Topics include husband and wife,
bastards, deeds, highways, justices courts, militias, oaths,
physicians and surgeons, slaves, "surety of the good behaviour," towns

* Later edition, the first issued after Pennsylvania's ratification of
the Constitution. While the first Parker edition was printed in 1764,
this popular title was adapted and reissued by several printers. It is
largely based on English sources, primarily Burn. Part II (pages 384-
461) contains "The Office and Duty of Sheriffs," "A Guide to Juries,"
"An Abstract of Magna Charta," "Of Maxims and General Rules, from
Jacob's Law Grammar," "Of Actions and Remedies," "Of Fictions,
Intendments, and Presumptions," and "An Act Concerning the Duties on
Spirits Distilled Within the United States, Passed, in Congress, the
8th of May, 1792." This was one of the acts that provoked the Whiskey
Rebellion in western Pennsylvania. It is omitted in later editions.

edges, corners, joints and spine ends. Early owner signatures to
preliminaries. Front joint of Volume III starting, all hinges cracked
or starting. Offsetting to endleaves and title pages, interiors
otherwise fresh. A nice set. $450.
* Fifth edition. First published in 1720, this set collects the
letters, essays, political and diplomatic papers, memoirs, and other
writings of the notable British statesman and ambassador who
negotiated the Triple Alliance (1668) and the marriage of William of
Orange and Princess Mary of England (1677). Temple was also an
important prose stylist and the author of important essays on
politics, government, morals and manners. His work had a profound
influence on his secretary, Jonathan Swift. (Temple's essay "Of
Ancient and Modern Learning" initiated the famous "ancients versus
moderns" controversy that inspired "The Battle of the Books").
According to the British Museum Catalogue, the "Life and Character of
the Author" was probably written by Temple's sister, Lady Giffard.

* Fourth edition. Warren, an English barrister and the author of A
Popular and Practical Introduction to Law Studies, wrote several
novels and sketches with legal themes, such as Ten-Thousand a Year.
Adventures of an Attorney, a charming tale that recounts the trials,
tribulations and small triumphs of a novice attorney, was one of his
most successful books.
