Kansas, Wyandotte County. ARCHIVE OF COURT DOCUMENTS: STATE OF KANSAS VS.
MARY KERN, ACCUSED OF MAKING AND DISTRIBUTING MOONSHINE WHISKEY, 1925.
Kansas City, Kansas, 1925. Original documents. Archive comprises 21 pages,
folio: Criminal Action Subpoena; Jury Trial summary; Motion for New Trial;
Parole Bond; Instructions to the Jury [8 pages, covering 16 points];
witness affidavit; petition to revoke parole; Verdict. Most leaves are 14"
x 8.5" and docketed on versos. Very Good.
The witness in this case, one Dan Wilson, said that he went with two
policemen to Mary Kern's residence at 302 North 1st Street, Kansas City,
"...and found seated around a table several people, part of them being
colored and part of them white, both men and women in the house and the
house was full of children. Sitting on the table in front of the people
were whisky glasses they were using and drinking from and sitting on the
table was a gallon jug containing about a half gallon of corn
whisky....Mrs. Kern grabbed a poker and struck several times at me and the
whisky attempting to break the jug....I succeeded in getting the whisky
away from her and out of the house...the people were placed under arrest
and taken to the City Hall...." The extensive Instructions to the Jury note
that back in March, 1923, a house at 333 North 1st Street was "maintained a
common nuisance to the people of the State of Kansas...by said defendant,
Mary Kern, John Doe, Sallie Coe and Richard Roe, whose real names are
unknown...kept and do now unlawfully keep and maintain a place where
intoxicating lilquors were and are manufactured, sold, bartered and given
away...bottles, glasses, jugs, kegs, barrels, cases, a still and other
receptacles...." Mary Kern pled not guilty to these charges. The jury
verdict may be read by the next owner of this archive.  $90.00
