[Rarebooks] FS: 1641 and 1651: Two Mexican contracts quite possibly concerning: Land/Water Rights between the Spanish and the Indigenous Populations of Morelos:

most Spanish grammar, nor iin possession of anything approaching fluency in secretary hand, offers (pant pant)
these two seventeenth-century Mexican manuscript documents.


Various. SEVENTEENTH-CENTURY MEXICAN LAND AND WATER RIGHTS DOCUMENTS (1641 AND 1651
MANUSCRIPTS). Morelos, Mexico: N/A, 1641. The piece appears to be two separate, but perhaps not unrelated documents,
the first dated 1641 and three pages, the second 1651and six.  Document #1 The first part is a land and water report dated 1641, documenting an
exchange of land exchange in the relatively. new colony of Xochitepec. Heading reads: "Second seal of the Sixth
reign, in the year OneThousand, Six Hundred and Fifty-one. The document was prepared and written by Christoval
Romero de Remamentes, possibly a church official. As evident by the two stamps with the heraldry of King Philip IV of Spain
in the top left corner of the first leaf, the document was reviewed and approved by someone related to the crown; the
last leaf makes note of a Marques de Guadalcazar, who may have been the reviewer of the document. The lower stamp,
indicating the year 1651 may mean that the document was reviewed and validated again ten years later. The first leaf
describes the granting of land and water rights from Don Christoval Rodriguez de Riego y Menoca to Don Diego de Simoca y
Castro. 

The land and water in question is in the town of Atlacholoaya along the Rio Apatlaco, located in the modern-day
province of Morelos, Mexico. The stretch of land runs from Atlacholoaya to Quexotimeo. The verso of the first leaf describes
the land of Anton Martin Fragoso, whose land stretches from beneath Casa della Fracia (possibly misspelled for Francia) to the
north to the Corre de Sur, where Christoval Romero y Pedro Hernandez de Cessa’s land begins. It also appears to dictate the
land relation between Don Juan Ramireide, Don Rodriguez del Riego y Mendoca, and Anton Martin Fragoso. It appears to say
that the land and water used to belong to the indigenous population. The second leaf describes the land owned by Don Diego
Fernandez de (?). It seems that Christoval Romero de los Remanentes, the one preparing the document, granted the water
rights of the Rio de Santa Elena Cruz and the land from the river to the city of Quexotingo to Don Diego Fernandez. It also
describes the land and water ownership of Sebastian Ximenez and Gazpar Banela. The end of the last leaf has a different hand
and a signature, possibly related to the second review in 1651. The last page also says when the entire colony was formed: on
the sixth of June 1616. The names El Marques de Guadalcazar and Viceroy Pedro de las Torre are mentioned in the last
statement in the primary hand after the date, perhaps telling the two primary people in charge of the colony. --------------
Document #2 The second document is dated to 1651 and also has two crowned seals. It mentions the contract lawyer Nicolas
Romero de Mella and Antonio Nuñez de Cabrera, and possibly the city of Quechultenango, located in Guerrero, Mexico. It
mentions a monetary transaction of tribute, saying that someone owes the other money and/or property. The handwriting is
very legible, so further analysis from one more familiar with secretary hand would be in order. Very Good. MANUSCRIPTS.
