23. Webster, Daniel and Hayne, Robert. WEBSTER AND HAYNE'S CELEBRATED
SPEECHES IN THE UNITED STATES SENATE, ON MR. FOOT'S RESOLUTION, OF
JANUARY, 1830. ALSO, DANIEL WEBSTER'S SPEECH IN THE SENATE OF THE
UNITED STATES, MARCH 7, 1850, ON THE SLAVERY COMPROMISE.
Philadelphia: T. B. Peterson & Brothers, (ca. 1857). 115 pp. +
adv.[13 pp]. 8vo. Stitched paper wrappers. Later printing. Cover
title shows the correct date of Webster's Speech: March 7, 1850. The
ad on next to last page is that of Peterson's magazine for 1858. The
first section contains the speeches of one of the great debates in
American history that showed the fault lines of the country and led
to Webster's brilliant destruction of the theory of Nullification
(which held that states have the right to declare null and void any
federal law that they deem unconstitutional) and his espousal of a
national theory of the constitution. The 7th of March speech (1850)
was perhaps Webster's last important speech, and though it followed
from some of his earlier statements, his support of Clay's elaborate
compromises created a great uproar in the North and injured his
reputation, a fact of which he was well cognizant. Of this speech
Emerson wrote: "Mr. Webster has delliberately taken out his name from
all the files of honour... He has undone all that he spent his years
in doing." A good copy with small chips in the wrappers, rear wrapper
detached, dampstained throughout. Goldsmiths Kress 37197.12 (1850
ed). Lib. Company. Afro-Americana, 11032. [27412] $30

24. Webster, Daniel and Whipple, [John]. THE RHODE ISLAND QUESTION.
ARGUMENTS OF MESSRS. WHIPPLE AND WEBSTER, IN THE CASE OF MARTIN
LUTHER, PLAINTIFF IN ERROR, VERSUS LUTHER M. BORDEN AND OTHERS, IN
THE SUPREME COURT OF THE UNITED STATES, JANUARY TERM, 1848.
Providence: Charles Burnett, 1848. 56 pp. 8vo. Stitched paper
wrappers. First edition. Signed T. A. Jenckes. Thomas Allen Jenckes
(1818-1875) was a Brown graduate and lawyer who served in the Rhode
Island General Assembly and later in the United States House of
Representatives from 1863 to 1871. Webster sided with the Chartists
in this case involving Dorr's rebellion which sought to set up a
popular government in Rhode Island as opposed to the one still ruled
under the King's charter. Webster argued against the theory of first
principles "...let me state what I understand the American principles
to be, on which this system rests... that the people are the source
of political power. Government is instituted for their good... [but]
the exercise of legislative power and other powers of government
immediately by the people themselves is impracticable, they must be
exercised by representatives of the people... [and] the people limit
their governments and ... equally important, that the people often
limit themselves...." Thus the majority does not always rule, and
Dorr's 14000 votes to the Chartists 7000 holds no relevance. OCLC and
RLIN show only 6 copies: Brown, Duke, Harvard, Yale, LOC, NYHist.Soc.
Wrappers chipped and soiled, else a very good copy with some
scattered foxing and a few creased corners. Sabin 70732. Cohen 12004

28. Junius Americanus (pseudonym of George Osborne Stearns). A REVIEW
OF "A DISCOURSE OCCASIONED BY THE DEATH OF DANIEL WEBSTER, PREACHED

MINISTER OF THE TWENTY-EIGHTH CONGREGATIONAL SOCIETY IN BOSTON."
Boston and Cambridge: James Munroe and Company, 1853. 89 pp. 8vo.
Stapled paper wrappers. First edition. Presentation copy (only first
name remains) signed "With the Respects of the Author." Theodore
Parker was a New England Transcendentalist and anti-slavery activist
. Stearns felt Parker's sermon pernicious: "By an unheard of ferocity
of attack upon the dead man's fame in a funeral sermon this man has
put himself beyond the pale of conventional protection. He has shown
no mercy to the dead, we shall show none to him living." Wrappers
chipped, edges darkened, tear to top corner of title page, offsetting
