list. Octavo (4-1/2" x 6-1/2"). Later morocco signed binding by
MacDonald, gilt double frames to boards, raised bands and gilt
ornaments to spine, inside dentelles, top edge gilt, endpapers
renewed. Negligible wear binding, offsetting to outer margins of
endleaves. Later armorial bookplate of George R. Dyer to front free
endpaper. Small clean tear to a leaf expertly mended. Light toning to
text block. Foxing and offsetting to margins of title page, light
foxing to a few leaves. An attractive copy. $2,000.
* Second American edition, and one of the three colonial printings of
Magna Carta. First published in America in 1721 by John Franklin, this
assertion of English rights was one of the very first legal books
published in the American colonies. The edition of Magna Carta is
based on Coke's gloss, and its enumeration of fundamental rights was a
profound influence on the founding fathers. George Mason used it when
drafting Virginia's Declaration of Rights (1776). Jefferson, who owned
two copies, probably referred to it when he wrote the Declaration of
Independence and the Virginia Statute for Religious Freedom. Its
influence is also evident in the Bill of Rights. This edition was
published a few months after the passage of the Intolerable Acts, and
it is almost certain that the publisher was capitalizing on popular
resentment toward the crown and parliament. A note at the end of the
table of contents says this edition was "principally designed for
America" and contained "extracts from several late celebrated writers
on the constitution" (vi). Dyer was a Major general during the First

first and second gatherings. Early owner signatures to front free
endpaper and head of title page, interior otherwise clean. $450.
* Third edition. First published in 1742, this was edited from an
anonymous manuscript by John Worrall. In the introduction to a later
reprint of this book, J. Wesley Miller said this was "the most
conspicuous early volume of English legal poetry.... [I]t cast the
holdings of the first eleven Parts of Coke's Reports...into heroic
couplets and thereby forged a link between law and poetry which would
culminate in John Anstey's The Pleader's Guide (1796) and John Crisp's

[Cunningham, Timothy (d.1789)]. A New Treatise on the Laws for
Preservation of the Game: Containing All the Statutes, Cases at Large,
Arguments, Resolutions, and Judgments Concerning it; Equally Useful to
the Gentleman and Farmer; As the Genteman May Learn How Far His
Privilege Extends, and the Farmer May be Enabled to Know When the
Gentleman Exceeds the Limits Prescribed by Law, and the Proper Methods
of Redress. Together with All the Acts of Parliament Relating to the
Sale of Fish in the Cities of London and Westminster. London: Printed

1/2"). Contemporary calf, blind frames to boards, blind fillets to
joints, raised bands and lettering piece to spine. Negligible
offsetting to endleaves, dampstaining to margins of a few leaves,
interior notably fresh otherwise. A handsome, well-preserved copy of
an uncommon work. $1,350.
* First edition. Pp. 137-263 are devoted to the laws on fish and
fishing. "[A new treatise on this subject]...is very necessary for the
justice of the peace, because matters of this nature are frequently in
judgment before him; nor is it to be doubted, that the attorney has
also frequent occasion in the course of his practice to consult the
laws concerning the game: And it is absolutely necessary for the
sporting gentleman, as he may act with safety in the pursuit of his
rural pleasures. And the farmer too may be enabled to know when the
gentleman exceeds the limits prescribed by law, and what is the
properest method to seek redress when he is aggrieved. Another reason,
why a new treatise on the Game-Law is become necessary, is, the
multiplicity of new statutes that have been passed, and the cases that
have been determined within these passed few years, and which have
almost entirely altered the face of the Law with respect to these

member of the Middle Temple and the author of an important law

woodcut head-pieces, tail-pieces and decorated initials. Light toning
to text, light foxing to a few leaves. Small early annotation and
small later inkstamp to title page, interior otherwise clean. A nice
copy of a rare title. $2,200.
* Only edition. With index. Attributed in some sources to Heineccius,
this volume contains critical editions of the Lex Visigothorum, Lex
Burgundionum, Regum Francorum, Edictum Theodorici Regis and other
important early sources of Germanic law. It is an important milestone
in the history of German legal philology and a precursor to the work
of the historical jurisprudents of the nineteenth century. OCLC
locates 1 copy; the Karlsruhe Virtueller Katalogue (KVK) locates 2.

second son of Denis Godefroy [1549-1622], who was, like his father, a
formidable humanist legal scholar. Quatuor Fontes Juris Civilis one of
his most important works. It is a collection of ante-Justinian Roman
law texts that includes the first reconstruction of the Twelve Tables.

Pennsylvania: Containing Extracts of the Acts Now in Force, and the
Cases and Determinations of the Court of Common Pleas of the First
Judicial District, and of Other Courts. Philadelphia: Philip H.
Nicklin, 1822. xx, 167 pp. Tipped-end errata sheet. 12mo. (5" x 8").
Contemporary three-quarter calf over paper boards, lettering piece and
blind fillets to spine. Rubbing to spine ends, joints and board edges
with minor wear, corners bumped, stains to boards, a minor scuff to
front joint, another to front board, hinges just starting.
Dampstaining and occasional light foxing to text. Early owner
signature in fine hand to head of title page, interior otherwise
clean. $500.
* First edition. (A second edition was published in 1827 with a
slightly different title). One of the first books on the subject
published in the United States, it outlines the Pennsylvania insolvent
laws and their application by the court of common pleas. It is an
important source for the history of early American bankruptcy law and
is cited in Peter J. Coleman's Debtors and Creditors in America:
Insolvency, Imprisonment for Debt, and Bankruptcy, 1607-1900 (148).

Federal Government. Designed Chiefly for the Use of Schools,
Academies, and Colleges. Philadelphia: George W. Childs, 1863. 324 pp.

cloth, gilt title to spine. Moderate rubbing with some wear to spine
ends, joints and corners, minor inkstain to front board. Early owner
signatures to pastedowns, light foxing to most of text. $150.
* Fourth printing. First published in 1855, this popular textbook
"designed chiefly for the use of schools, academies, and colleges"
went through five printings. An abridged edition was published in
1866. Sheppard practiced law in Philadelphia beginning in 1848; he
served as District Attorney there from 1868 to 1871 and from 1874 to
1877. This edition not in Bauer or Cohen.
